Winelands Menu is a digital menu platform operated by Rikus Jones, based in Paarl, South Africa (“Winelands Menu”, “we”, “us”, “our”). These Terms and Conditions (“Terms”) govern the use of the website at winelandsmenu.co.za and the services provided through it (together, “the Service”).
By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a restaurant, wine estate or other business, you confirm that you are authorised to accept these Terms on that business’s behalf, and “you” refers to that business.
If you do not agree with these Terms, please do not use the Service.
Winelands Menu allows venues (“Customers”) to create and manage digital menus that guests can view by scanning a QR code. The Service includes, among other things, menu creation and editing tools, QR code generation, branding and theme options, and menu view analytics.
Diners and visitors who view a menu by scanning a QR code (“Guests”) may do so without an account. Sections 8, 12 and 13 apply to Guests; the remainder of these Terms apply to Customers.
To use the Service as a Customer you must register an account with accurate, current information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@winelandsmenu.co.za if you suspect unauthorised access to your account.
You must be at least 18 years old and legally capable of entering into a binding agreement to register an account.
New Customers receive a 30-day free trial of the Service. No payment details are required to start the trial.
At the end of the trial, continued use of the Service requires a paid subscription. If you choose not to subscribe, your published menus may be deactivated and your account access limited. We will retain your account data for 60 days after your trial ends so you can pick up where you left off if you subscribe later; after that we may delete it.
Subscription fees are as quoted to you or as published on winelandsmenu.co.za, in South African Rand. We currently invoice Customers directly, with payment by EFT due within 14 days of the invoice date, unless agreed otherwise in writing.
If an invoice remains unpaid after its due date, we may suspend your account and published menus after giving you reasonable notice, and will reactivate them once payment is received.
We may change our fees from time to time. Existing Customers will be given at least 30 days’ written notice of any price change before it takes effect.
Except where required by law, fees already paid are non-refundable, including for partly used subscription periods.
You retain full ownership of the content you upload to the Service, including menu items, descriptions, prices, images and logos (“Customer Content”). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display Customer Content solely for the purpose of operating and providing the Service — for example, displaying your menu to Guests who scan your QR code.
You are solely responsible for your Customer Content, including:
We may remove or disable Customer Content that we reasonably believe is unlawful, infringing or in breach of these Terms, and will notify you where practical.

Public menu pages are provided for information only. Menu content — including prices, availability, and allergen or dietary information — is created and maintained by the venue concerned, not by Winelands Menu. Guests should confirm important details, especially allergen information, directly with the venue.
The Service — including its software, design, branding and underlying technology — is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any of our intellectual property to you. If you send us feedback or suggestions, we may use them without any obligation to you.
We aim to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service relies on third-party providers (such as hosting and database infrastructure) and may occasionally be unavailable due to maintenance, updates or events beyond our control. Where planned maintenance is likely to cause noticeable downtime, we will try to give advance notice.

We process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and our Privacy Policy, available at winelandsmenu.co.za/privacy. The Privacy Policy explains what information we collect, why we collect it, and your rights regarding it.
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we make no warranties, express or implied, about the Service, including implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Service will meet your requirements or that it will be uninterrupted, secure or error-free.
Nothing in these Terms excludes or limits any right or remedy you may have under the Consumer Protection Act, 2008 or any other law to the extent that it cannot lawfully be excluded or limited.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss or damage, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with the Service.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these Terms or the Service will not exceed the fees you paid to us in the three months immediately preceding the event giving rise to the claim (or R1,000 if you have not paid any fees).
You indemnify us against claims, damages and costs (including reasonable legal fees) brought by third parties arising from your Customer Content or your breach of these Terms — for example, a claim arising from inaccurate allergen information on your menu, or from content you did not have the right to use.
You may cancel your account at any time by emailing us at hello@winelandsmenu.co.za. Cancellation takes effect at the end of your current paid period, and no refunds are given for the unused portion, except where required by law.
We may suspend or terminate your account if you materially breach these Terms and do not remedy the breach within 7 days of written notice, or immediately in the case of serious breaches such as unlawful use of the Service.
After termination, we will retain your Customer Content for 30 days, during which you may request an export, after which we may delete it.
Winelands Menu is a growing product and we may add, change or remove features over time. We may also update these Terms. If we make material changes, we will notify you by email or through your dashboard at least 14 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may cancel your account before they take effect.
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them. If any provision of these Terms is found to be unenforceable, the remainder will continue in force. Our failure to enforce any provision is not a waiver of it. You may not assign your rights under these Terms without our written consent; we may assign ours to a successor of the business. These Terms, together with the Privacy Policy and any written agreement between us, constitute the entire agreement between you and us regarding the Service.
