Privacy Policy

Winelands Menu (“Winelands Menu”, “we”, “us”, “our”) is operated by Rikus Jones, based in Paarl, South Africa. This Privacy Policy explains what personal information we collect through winelandsmenu.co.za and the services provided through it (“the Service”), why we collect it, how it is stored, and the rights you have over it under the Protection of Personal Information Act, 2013 (“POPIA”).

This policy applies both to venues that create an account to manage a digital menu (“Customers”) and to diners and visitors who view a menu by scanning a QR code (“Guests”).

Customers. When you register for an account we collect your email address and your estate or business name. We also hold any Customer Content you upload to build your menu (item names, descriptions, prices, images and logos), which is covered separately in our Terms and Conditions.

Guests. We do not require Guests to create an account or provide any personal details to view a menu. When a menu is viewed, we collect anonymous menu-view analytics — such as which menu was viewed and when — to help Customers understand how their menu is being used. This data is not linked to an identifiable individual.

We use the information described above to:

• create and manage Customer accounts, and authenticate logins;
• operate, host and display digital menus to Guests;
• communicate with Customers about their account, trial, billing and support requests;
• provide Customers with anonymous, aggregated analytics about menu views; and
• maintain the security and proper functioning of the Service.

We process Customer account information on the basis that it is necessary to perform our contract with you (providing the Service), and menu-view analytics on the basis of our legitimate interest in operating and improving the Service, in a way that does not identify individual Guests.

Personal information is stored in Supabase, our database and authentication provider. Supabase hosts data on secure cloud infrastructure and provides the account authentication that protects Customer logins. We take reasonable technical and organisational measures to keep information secure and to protect it against loss, unauthorised access, and unlawful processing.

We share personal information with the following third-party service providers, who process it on our behalf strictly to help us operate the Service:

• Supabase — database hosting and account authentication.
• Netlify — hosting of the winelandsmenu.co.za website and Service.
• Amazon SES — sending outbound account, billing and support emails.
• ImprovMX — forwarding inbound email sent to our @winelandsmenu.co.za addresses.

Each of these providers only processes personal information as needed to deliver their service to us and is not permitted to use it for their own purposes. We do not sell personal information to any third party.

We keep personal information only for as long as necessary for the purposes described in this policy:

• If a free trial ends without a paid subscription, we retain account data for 60 days after the trial ends, after which it may be deleted.
• If a Customer account is terminated, we retain Customer Content for 30 days after termination, during which an export may be requested, after which it may be deleted.

Anonymous menu-view analytics are not linked to an identifiable individual and are retained for as long as needed to provide Customers with usage insights.

Subject to POPIA, you have the right to:

• Access the personal information we hold about you;
• Correct any personal information that is inaccurate, outdated or incomplete;
• Request deletion of your personal information, subject to any legal or contractual obligations we may have to retain it; and
• Object to the processing of your personal information in certain circumstances.

To exercise any of these rights, contact us at hello@winelandsmenu.co.za. We will respond to your request within a reasonable time and in accordance with POPIA. You also have the right to lodge a complaint with the Information Regulator of South Africa if you believe your information has been processed unlawfully.

We may update this Privacy Policy from time to time, for example as the Service evolves or as our third-party providers change. If we make material changes, we will notify Customers by email or through the dashboard. The “last updated” date at the top of this page shows when it was last revised.
